Thank you for using the SecondDesk platform ("Service", "We", "Us", or "Our"). By accessing our services, you confirm your legal agreement to be bound by these Terms of Service.
1. Introduction & Acceptance
By accessing or using the SecondDesk platform, registering an account, or interacting with our APIs, you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you are accepting on behalf of a company, you represent that you have the authority to bind that entity to these terms.
2. Account Security
You are responsible for maintaining the confidentiality of your account credentials. SecondDesk cannot and will not be liable for any loss or damage from your failure to maintain the security of your account and password. Report any security breaches immediately to admin@secondmedia.co.uk.
3. Acceptable Use Policy
When using our services, you agree not to:
- Use the Service for any illegal, unlawful, or unauthorized purpose.
- Attempt to disrupt, degrade, or compromise the integrity or security of the Service (e.g., DDoS, spamming, exploiting).
- Violate the privacy, intellectual property, or other rights of third parties or your own customers.
- Reverse engineer, decompile, or copy the platform's source code or proprietary algorithms.
4. Subscriptions & Billing
SecondDesk offers paid subscription plans (e.g., Professional, Enterprise), generally billed monthly or annually in advance.
- Payment Processing: All payments are securely handled by Stripe. We do not store your credit card information on our servers.
- Price Changes: We reserve the right to adjust pricing. Existing subscribers will be notified at least 30 days prior to any changes taking effect.
- Taxes: Listed prices may be exclusive of applicable taxes like VAT, depending on your billing location.
5. Cancellations & Refunds
You may cancel your subscription at any time via the "Billing" section in your dashboard.
For first-time subscribers, we offer a full refund within 14 days of purchase, provided the service has not been heavily utilized. Canceled subscriptions remain active until the end of the current paid billing cycle, after which account features are locked.
6. Intellectual Property
All rights, title, and interest in and to the SecondDesk platform (including software, design, text, graphics, and logos) are owned by Second Media Ltd. and are protected by international copyright and trademark laws. Unauthorized reproduction or commercial distribution is strictly prohibited.
7. Limitation of Liability
To the maximum extent permitted by applicable law, SecondDesk is provided on an "AS IS" and "AS AVAILABLE" basis. We do not guarantee that the service will be flawless, uninterrupted, or perfectly secure.
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including data loss, revenue loss, or business interruption) resulting from your use or inability to use the Service. Our total liability is capped at the amount you paid us in the 12 months preceding the claim.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of England and Wales. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of London, United Kingdom.
